Nevis, the smaller half of the island state of St Kitts and Nevis, is regarded as one of the strongest creditor protection jurisdictions in the world. The Nevis LLC Ordinance and the Nevis International Exempt Trust Ordinance provide exceptionally robust protective structures that US and European courts find very hard to challenge.
Why Nevis for asset protection?
Nevis law puts exceptionally high hurdles in creditors' way: claims against Nevis structures must be filed locally, a claim against a trust requires a bond of 270,000 Eastern Caribbean dollars (around USD 100,000), and the deadline for challenging a transfer is only two years. The Nevis International Exempt Trust Ordinance allows self-settled trusts with full creditor protection, a structure that is not possible in most other jurisdictions. Nevis is not an EU member; St Kitts and Nevis has reported account data under the OECD CRS standard since 2018.
Offshore foundation in Nevis
A Nevis foundation (International Exempt Trust or LLC) is ideal for: protecting investment assets from creditors and claimants, holding international shareholdings and property, passing wealth across generations with a minimal tax footprint, and as a basis for family wealth that is to be held outside the reach of the EU. Combining a Nevis LLC with an offshore trust offers maximum protection.
The tax framework
Nevis levies no taxes on the income, capital gains, dividends or inheritances of offshore structures. For non-residents and offshore companies, the effective tax burden is zero. The beneficiary's tax residence in their home country remains decisive, so professional structuring is essential.
